Lease Option Consulting

QUESTION:
I’ve talked to a seller who’s had their property listed for several months, with no offers. The listing has expired. My agent friend ran a CMA, and it came in at $130,200. Owners owe $129,000. Mortgage payment is $1181 per month, where fair market rent is probably around $1,000. Property mainly just needs paint and cleaning.

Owner says they are not behind on payments, but it’s a struggle (they live out of state, and making mortgage payments on that property, also). What are some ideas for an offer (if any) on this property?

ANSWER ONE:
In my eyes it’s a rental, or a long term lease option with possible assignment.

QUESTION TWO:
I’ve since talked to the property management company, handling the house across the street. It rents for $925 per month, with kitchen and bathrooms recently upgraded. It is smaller than the target property, but something that has to be considered.

I’m not interested in just being the middle-man in a rental.

ANSWER TWO:
Right.
And no, I didn’t mean you being in the middle. For an assignment, maybe. I wouldn’t hold this one, that’s for sure.
Would I consult for the seller? Sure. I’d help them by explaining the lease option and give them “sample” agreements such as those in the course. Make sure they’re attorney looks at them and they know you are NOT an attorney, or acting in that capacity.
My good friend Michael Carbonare does these all the time.
I usually charge at least $500 for my services if I help the seller.

Five Ways to Assign a Lease Option Deal

QUESTION:
Hey Adam, I hope everything is great with you.

I have a deal I am working on where I have a property under contract with the seller for $14k. I have found a buyer that will pay $16k and they are willing to put down $8k for the option consideration to purchase at $16k. So that leaves me with a $2k assignment fee (16k-14k), and the seller netting the difference of $6k on the front end and the buyer will pay off the remaining $8k over the next 18 months on the lease purchase. So payments would be remaining $8k divided by 18 months = $444.44 per month for the 18 months-then title will transfer over to buyer (full $444.44 per month or 100% would be credited to principal balance).

My question is the paperwork on the Cooperative option agreement and how I acknowledge my $2k fee somewhere on the agreement. So I can enter in the Lease Purchase agreement directly with my seller from your Option to Purchase (non compete) for $14k, and write up the 18 month Lease agreement for $444/month and 100% credited towards purchase. Then I fill out the assignment addendum over to the new buyer so that he enters into a direct Lease with Option to Purchase with the seller. But where do I document my $2k assignment fee?

Please help, I need to meet with them tomorrow and wrap this up!

ANSWER:
1. Simply assign your interest and hand them (Owner and buyer) blank “sample” agreements. (don’t fill them out for them, you’re not an attorney)

Or.

2. I would simply assign my original documents (or release them) over to the seller for $2K upon “that specific person” purchasing and closing.
This way you’re assigning your interest, the seller and buyer go into contract, they put down the money, which is written to all go towards the purchase price.
Then, after closing, the buyer walks out with a legitimate set of agreements and you get a check. This way the buyer has no idea what you’ve been paid.

Or.

3. Assign to the buyer for $2K and let them close with the seller.

Or.

4. Go into contract with the seller as the buyer, (exercising your cooperative option agreement) and assign your interest to the buyer for $2K (Basically same as number one)

Or.

5. Go into contract “as the seller” with the buyer, close, and assign to the seller for $2K, (this is exercising your original Cooperative Purchase) give them the rest of the money and the contracts, and give the buyer a “notice of assignment” and the seller’s information.

Lot’s of ways to spin it depending on how you want to do it.

Wholesaling Lease Options

Quick note on “wholesaling lease options”.

First off, wholesaling is buying low and selling low.  Heck, for the sake of argument, let’s call it “optioning low and assigning low”.  So, which part of lease option assignments, or cooperative assignments is selling low? That’s right, none of them. The word wholesaling is a brand, albeit a good one, an incorrect description of what’s really happening.
