The Cooperative Purchase in Other States
QUESTION:
I planned on using this system in other states too. When you’ve used the Cooperative Agreement in other states. did you have to change Section Q. (Governing Law, Jurisdiction and Venue:) from the state of Michigan to the state that you were doing business in?
For example, when you did your deal(s) in Georgia did you have to change Section Q. from Michigan to Georgia?
ANSWER:
This is not legal advice, but my opinion on past transactions. And no, I kept it MI because if anyone tried to take me to court they’d have to come here to do it! That was the original reason for the clause. It’s also letting people know if I’m in there state I don’t know their laws. I could have done an ambiguity clause, but would rather people think I was competent enough to know what I was doing.
So in short, no I didn’t change the cooperative option agreement ever, not once. The lease from state to state always changed but the tenant’s option didn’t change either.
